Undercover Buy: 4 arrested in bust of drug distribution operation

DELMAR—An undercover distribution buy at a Delmar residence led to the execution of a search warrant in the dusky hours of Friday, Aug. 19, when over a pound of marijuana was seized, guns confiscated and four persons arrested.
Taken into custody behind the residence around 8 p.m., were James Christopher Burleson, 44, of Phil Campbill, charged with possession of marijuana second degree; and the three Haleyville residents, Gary Dale Hornsby, 45, arrested on failure to pay child support; Justin Alsup, 49, possession of marijuana first degree and possession of a controlled substance and Justin’s son Joshua James Alsup, 25, possession of marijuana first degree and distribution of a controlled substance, according to the Winston County Sheriff’s Office.
All of those arrested at the scene were transported to the Winston County Jail, Double Springs.
Prior to Friday, authorities made a distribution buy at a two floor white residence behind an storage shed at 12749 Highway 13. Due to that buy, a search warrant was obtained and executed around 7 p.m. Friday, Aug. 19.
As authorities were in the process of executing the search warrant, they saw two persons attempting to flee, running out the side of the residence, while a separate individual was attempting to flee from another area of the residence, noted Tommy Moore, chief investigator with the Winston/Marion County District Attorney’s Office.
All three subjects attempting to flee were secured on the porch which actually wraps around the residence. When authorities stepped to the door, they notice a large plastic bag. “It’s plenty…to catch my interest, when I saw it,” Moore said.
Six to eight persons were found to be at the residence, as authorities secured the front, after the search warrant was executed. One team entered the residence, where authorities believe a marijuana distribution operation had been ongoing at least the past two to three months.
“When we hit the room, they started running and throwing things on the floor,” one investigator said.
Multiple undercover buys from law enforcement over the past six weeks or so led to the Aug. 19 raid, they added.
“We have been working on several houses across the county,” noted Winston County Sheriff Rick Harris. “We focused on this one, due to the high level of traffic.”
Inside the residence, authorities found a large bag of marijuana, with marijuana in a tin container found in a separate area of the home. Altogether, approximately one pound of marijuana was found.
Subjects were removed and secured behind the residence.
“We go information there were guns in the house,” Moore said. A convicted felon, according to Alabama law, cannot be in possession of a firearm, as was the case here, according to authorities. In one room, where marijuana and some controlled substance pills were located, were an assortment of rifles.
The rifles were turned over to ATF for investigation, authorities said.
Agencies involved in the case include Winston County Sheriff’s Office, Winston/Marion DA’s office, police departments form Double Springs and Arley and Alabama Department of Tobacco and Firearms.
Although six to eight persons were at the residence when the raid occurred, charges were only filed against four individuals.
*When a defendant is charged with a crime, the charge is merely an accusation until or unless proven guilty in a court of law.
